Throughout these Terms, “Company”, “we”, “us”, or “our” refer to SHOES LLC.


2. SCOPE AND ACCEPTANCE

2.1. These Terms govern all purchases of products made through the Site by customers located in the United States.

2.2. By placing an order, you confirm that:

  • you are at least 18 years old;
  • you have legal capacity to enter into a binding contract;
  • you have read, understood, and accepted these Terms and the Privacy Policy.

2.3. If you do not agree to these Terms, you must not place an order.


3. PRODUCTS AND CONTENT ACCURACY

3.1. The Company sells footwear, apparel, bags, backpacks, sporting goods, accessories, eyewear, and related products (the “Products”) from third-party brands.

3.2. Product images, descriptions, specifications, and availability are provided for informational purposes only and may vary due to:

  • manufacturer updates;
  • screen or device differences;
  • automated content generation.

3.3. Minor variations do not constitute defects.


4. ARTIFICIAL INTELLIGENCE DISCLOSURE

4.1. The Customer acknowledges that the Site uses artificial intelligence (AI) and automated systems to assist with:

  • product descriptions;
  • pricing logic and promotions;
  • categorization and recommendations;
  • inventory and merchandising optimization.

4.2. While reasonable measures are taken to ensure accuracy, AI-generated or AI-assisted content may contain inaccuracies or approximations.

4.3. The Company shall not be liable for damages arising solely from automated content, except where liability cannot be excluded by law.


5. ORDER PROCESS

5.1. Orders placed on the Site constitute an offer to purchase.

5.2. A binding contract is formed only after the Company sends an Order Confirmation email.

5.3. The Company reserves the right to refuse or cancel orders, including but not limited to cases involving:

  • pricing or inventory errors;
  • suspected fraud or abuse;
  • chargeback history;
  • resale or commercial intent;
  • violation of these Terms.

6. PRICES, TAXES AND FEES

6.1. All prices are shown in U.S. Dollars (USD) unless otherwise stated.

6.2. Prices do not include applicable sales tax, shipping fees, or other charges unless explicitly indicated.

6.3. Taxes and shipping costs are calculated and displayed during checkout.

6.4. Prices may change at any time but will not affect confirmed orders.


7. PAYMENTS – PAYPAL & STRIPE COMPLIANCE

7.1. Payments are processed securely via PayPal, Stripe, and other payment providers shown at checkout.

7.2. By submitting payment, the Customer authorizes the Company and its payment processors to:

  • charge the full order amount;
  • perform fraud prevention checks;
  • store transaction references required for legal and accounting purposes.

7.3. The Company does not store full card details. Payment data is handled directly by PayPal and Stripe in accordance with their security standards (PCI-DSS).

7.4. Orders may be suspended or canceled if payment authorization fails or is flagged by PayPal, Stripe, or fraud-prevention systems.


8. SHIPPING AND DELIVERY

8.1. Products are shipped to the address provided during checkout. Shipments to P.O. Boxes may be refused.

8.2. Delivery times are estimates only and are not guaranteed.

8.3. Risk of loss and title pass to the Customer upon delivery to the carrier, to the extent permitted by law.

8.4. The Company is not responsible for delays caused by carriers, weather conditions, force majeure events, or incorrect or incomplete delivery information provided by the Customer.


9. RETURNS AND REFUNDS (PAYPAL & STRIPE ALIGNED)

9.1. Customers may request a return within 30 days of delivery by contacting Customer Support at support.us@fuix.com.

9.2. To be eligible for a return, Products must:

  • be unused, unworn, unwashed, and undamaged;
  • include all original tags, labels, accessories, and packaging;
  • be returned in a way that prevents damage during transit.

9.3. After the return request is approved, the Company will provide return instructions and, where applicable, a return shipping label.

9.4. Return shipping costs are the responsibility of the Customer, unless the return is due to an incorrect or defective Product, in which case the Company will bear the return shipping costs and/or provide a return label.

9.5. All returns are subject to inspection. The Company reserves the right to refuse refunds for Products that do not meet the return conditions.

9.6. Refunds are issued to the original payment method only, in accordance with PayPal and Stripe policies, within 14 days from the date the returned Product is received and approved at the Company’s warehouse.

9.7. Original shipping and handling fees are non-refundable, unless the return is due to an incorrect or defective Product.


10. CHARGEBACKS AND PAYMENT DISPUTES

10.1. Customers agree to contact Customer Support before initiating a chargeback or payment dispute.

10.2. Unjustified chargebacks may result in:

  • suspension of the Customer account;
  • refusal of future orders.

10.3. The Company reserves the right to submit transaction records, shipping confirmations, and communications to PayPal, Stripe, and card issuers to contest disputes.


11. WARRANTIES DISCLAIMER

11.1. Products are provided “AS IS” and “AS AVAILABLE”, to the fullest extent permitted by law.

11.2. The Company disclaims all implied warranties, including merchantability and fitness for a particular purpose.

11.3. Some states do not allow limitations on implied warranties; in such cases, these limitations may not apply.


12. LIMITATION OF LIABILITY

12.1. To the maximum extent permitted by law, the Company shall not be liable for:

  • indirect, incidental, or consequential damages;
  • loss of profits, data, or business opportunities.

12.2. Total liability shall not exceed the amount paid for the Product giving rise to the claim.


13. INDEMNIFICATION

13.1. The Customer agrees to indemnify and hold harmless the Company from any claims arising from:

  • misuse of the Site or Products;
  • violation of these Terms;
  • infringement of third-party rights.

14. GOVERNING LAW AND JURISDICTION

14.1. These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules.

14.2. Any dispute shall be resolved exclusively in the state or federal courts located in the State of Florida.


15. SEVERABILITY

15.1. If any provision is held invalid or unenforceable, the remaining provisions remain in full force.
