1. GENERAL PROVISIONS
Maggini Group S.r.l. is a limited liability company established and registered in Italy (enrolled in the business register under number RM-1306435) with its registered office at Viale Carso 23, 00195 – Rome (hereinafter the "Company").
The Company engages in the retail trade of various products related to clothing lines of the best national and international brands, including footwear, backpacks, bags, sporting goods, and other miscellaneous items (the "Products") directly to its customers through the website www.fuix.com (the "Site").
The sale of Products on the Site is subject to the following terms and conditions of sale (the "Sales Terms").
These Sales Terms are valid when the Customer makes a purchase on the Site.
2. CONSUMER INFORMATION
2.1. The Products offered on the Site are available for sale to consumer Customers as well as to Professionals (as defined in art. 3, paragraph 1, letter c of Legislative Decree 206/2005).
The term "consumer Customer" refers to any individual making purchases for purposes unrelated to commercial, entrepreneurial, artisanal, or professional activities. The purchase of Products on the Site is only allowed for individuals over 18 years of age who possess a credit or debit card belonging to one of the circuits accepted by the Company and are authorized for its use. Some Products for sale on the Site may not be suitable for individuals under 18 years of age.
2.2. Before confirming and submitting a purchase order, the Customer must carefully read these Sales Terms, which are deemed accepted upon completion of the purchase process. These Sales Terms, together with the Privacy Policy, govern the contract between the Customer and Maggini Group S.r.l. regarding the sale of Products on the Site.
2.3. By submitting the purchase order, the Customer accepts and undertakes to comply with these Sales Terms. If the Customer does not accept any of the conditions stated in the Sales Terms, they must not submit a purchase order for Products on the Site.
2.4. These Sales Terms are important as they establish the respective rights and obligations of the Company and Customers and also provide useful information. Terms and conditions may be updated from time to time, so the Customer is required to check before making a purchase to ensure they are aware of the latest updates.
3. ORDER PROCEDURE AND ACCEPTANCE
3.1. To purchase one or more Products, the Customer must select the desired Products, choose the color, and indicate the required size. The selected Products for purchase will be added to the Cart. To have the option to save items in the Cart for later purchase, the Customer must first create an online account (User Profile) and register with that account at the time of purchase. It is possible to purchase without an online account/without registration, but all Products in the Cart will be deleted if the purchase process is not completed, and the Customer will need to start a new purchase process when returning to the Site at a later time.
3.2. The Customer has the option to modify any information entered during the purchase process until they confirm their order. Once the order is submitted, however, it will no longer be possible for the Customer to modify or cancel it. The Customer must then cancel it (and/or return the item/items purchased with the original order) and start the purchase process again to place a new order.
3.3. The sales procedure will be deemed concluded only when the Customer submits the purchase order to the Company by clicking the "Buy" button at the end of the purchase confirmation page. To submit the order, the Customer is required to provide certain personal data, including name, address, email address, and payment details. Additionally, they will need to check the relevant box to confirm that they have accepted these Sales Terms. Before submitting the order, it is recommended that the Customer carefully review the summary of their order, including Product details, cost details, shipping and delivery methods, conditions for exercising their right of withdrawal (the "Withdrawal Information," see point 7 below), information on legal warranty (see point 9 below), and the Privacy Policy.
3.4. Following the submission of the order, the Company will send the Customer an email confirming the receipt and processing of the order (the "Order Confirmation"). Customers can access their orders at any time from the "User Profile" section on the Site, if they have registered to avail themselves of the functionalities associated with having a "User Profile" on the Site, or by contacting Customer Service using the references provided on the Site's dedicated "Customer Service" page.
3.5. The Company reserves the right not to accept orders placed by the Customer if it finds or believes that they do not meet the requirements for placing a purchase order or if they are made by individuals with whom there is a legal dispute related to a previous order or for any other legitimate reason. The Company also reserves the right not to accept and not to fulfill orders that appear to have been placed by merchants and/or distributors.
3.6. For each Product offered for sale on the Site, an image of the Product will be displayed on the Site, along with the total unit price (indicating any discount and its percentage compared to the manufacturer's suggested retail price, which will be indicated together with the final price, if available), available colors, and sizes. Product images are provided purely for illustrative purposes. The images and colors of Products offered for sale on the Site may not fully correspond to the real ones due to browser and/or monitor functionalities or other technical reasons not attributable to the Company. The Company is not responsible for any inadequacy of graphic representations of Products shown on the Site due to the aforementioned technical reasons.
4. PRODUCT AVAILABILITY
4.1. The Company undertakes to ensure the availability of all Products offered on the Site. However, in exceptional cases, it may happen that the Products offered for sale on the Site are not actually available.
4.2. If the Products ordered by the Customer are not temporarily available, the Company will inform the Customer by email used for the purchase. If the Products are not permanently available, the Customer's payment will not be charged. If the purchase amount has already been charged, a refund will be provided within 14 (fourteen) working days to the Customer's payment card used to place the order. Additionally, it will be necessary to wait for specific banking times to have visibility of the refund, depending on the conditions of the reference bank. The Company has no power to intervene in the refund timelines, which are at the discretion of the reference bank.
5. PRICE AND PAYMENT
5.1. The prices of Products available for sale on the Site are expressed in EUR (€).
5.2. All prices of Products available on the Site will be indicated as inclusive of VAT and also inclusive of shipping and delivery costs, which, if applied, will be separately indicated. Shipping and delivery costs depend on the destination and the type of delivery selected during the purchase process. Shipping and delivery costs and any other applicable taxes will be detailed in advance on the payment page in the Order Confirmation.
5.3. The Company accepts payments through PayPal and the associated payment circuits.
5.4. For payments via MasterCard, Visa, and PayPal, the purchased Products will be shipped to the Customer exclusively after verifying the data related to the Customer's payment card and only upon receiving authorization for the charge from the Customer's bank. The verification of payment card data may cause delays, but it will be minimized and normally does not require more than 24 hours; however, longer times may occur.
5.5. All Products come with an identification label that is an integral part of the respective Product. The Customer must not remove/modify the identification label of the Product until they have verified that the Product corresponds to the requested order or until they decide not to exercise the right of withdrawal as outlined in point 7 below.
The Customer must ensure that items are returned with their identification labels and in their original packaging, including hangers, bags, shoe boxes, dustbags, and gift packaging. The items must not have been used, washed, or damaged. Upon receiving a return, we determine at our sole discretion whether the products are in acceptable conditions. If the Company believes that the returned Products are not in acceptable conditions, it may, at its sole discretion, charge the purchase price and send back the products to the Customer.
In extremely remote cases, depending on the order value, shipping method, or selected delivery address, additional shipping and delivery charges may be applied, or customs duties and taxes may be charged as required by the customs authorities of the destination country. These additional costs may not be clearly visible at the time of order confirmation.
6. SHIPPING AND DELIVERY
6.1. Products will be shipped to the address provided during the purchase process. For security reasons, the Company does not ship any orders to post office boxes and does not accept any orders where it is impossible to verify the identity of the order recipient and the address of the individual.
6.2. For shipping and delivery operations of orders/returns, the Company exclusively uses the logistics service provided by Amazon Europe Core SARL. For any related information, the Company invites Customers to review the specific service conditions on the website https://www.amazon.it/gp/help/customer/display.html?nodeId=GNWCU626A4NXEEGJ, where shipping costs and methods are indicated. Make sure to review the respective privacy policy.
6.3. Products will be delivered within 1-6 working days from the Shipping Confirmation if standard shipping is chosen, based on the shipping address and the Customer's destination country, as well as the shipping method chosen by the Customer at the time of purchase. The Company will not be responsible for unforeseen delays and/or delays solely attributable to the Courier. Before shipping the Customer's purchases, the Company may need to confirm the Customer's details with the card issuer. The Company commits to do its best to minimize delays, considering that such operations normally do not take more than 24 hours.
6.4. If the Customer does not receive the Products within 7-10 (seven-ten) working days from the receipt of the Shipping Confirmation, it is advisable for the Customer to contact the Company at the contact details provided in the Customer Service section.
7. RIGHT OF WITHDRAWAL
7.1. Customers have the right to withdraw from the concluded purchase contract without any penalty and without specifying the reason within 365 days from the date of receiving the Products purchased on the Site, in compliance with the return information provided in the dedicated documentation inside the delivery package. However, exercising the right of withdrawal does not allow customers to exchange the purchased Product with another Product.
7.2. To exercise the right of withdrawal, customers must communicate to the Company their intention to withdraw from the contract using the following withdrawal form [HYPERLINK]. The Customer must return the Products in their original condition following the instructions provided by Amazon and clearly indicated in the product delivery package and also available here [HYPERLINK].
7.3. A refund will be issued to the Customer on the condition that the Products have not been used, washed, and are in the same condition as when delivered, with the original identification labels, complete with all parts, accessories, and the original packaging. If the Customer exercises the right of return for all Products included in the same purchase order, all Products must be returned simultaneously with the same shipment.
7.4. The Company reserves the right to verify the returned Products and refuse the return of Products that do not meet the requirements specified in point 7.3 above.
7.5. A full refund will be issued to the payment card used or the current account used for the purchase as soon as possible and in any case within 14 (fourteen) days from the date the Company first confirmed the receipt of the returned Products sent by the Customer, provided the conditions specified in point 7.3 are met. In case the Customer has expressly requested a more expensive type of delivery different from the least expensive standard delivery method generally used by the Company, the Company will be obliged to refund the delivery costs only up to the amount the Customer would have paid if they had accepted the delivery method proposed by the Company or by its logistics service provider on its behalf, which is less expensive and generally accepted.
7.6. If the returned Products were purchased as a gift, the refund will be issued to the person who made the payment. The refund payment date will be the same as the initial payment to the Company. Therefore, the party who made the payment will not incur any damage in terms of bank interest.
7.7. To return Products to the Company, customers must follow the instructions specified inside the product package and also available on the logistics service website of Amazon Europe Core SARL. The return labels provided for the return must be affixed to the package (outer side) following the specific instructions indicated therein. Additionally, the Customer must check for the presence of the identification label and accompanying commercial documents inside the package and obtain a copy of the receipt for the product return duly signed by the Courier, keeping it as proof of the return. If the Courier is used for the return of Products, all shipping costs, including the costs for the return of Products, will be borne by the Company, subject to what is indicated in this article.
Products must be returned following the specified methods inside the delivery package to allow the logistics service partner to handle the return operations optimally.
8. CHANGES AND CORRECTIONS TO THE TERMS OF SALE
8.1. The Company reserves the right to modify or correct these Terms of Sale, the Privacy Policy, the information on the Right of Withdrawal specified here, the Products offered for sale on the Site, and the prices of Products at any time and without notice to the Customer. The Company encourages the Customer to carefully check the Terms of Sale and the Privacy Policy each time they use the Site to make a purchase.
8.2. The Company will do its best to ensure that the prices and other information about the Products displayed on the Site are accurate and promptly updated. However, occasional printing errors, incorrect statements, or omissions ("Errors") regarding the description, price, promotions, offers, and availability of the Products in question may occur. The Company reserves the right, at any time and without notice to the Customer, to correct Errors, modify or update information, revoke offers containing such Errors, and cancel any order at any time before shipment.
8.3. If the Customer's payment card is charged for a canceled order under point 8.2, the Customer will be informed by the Company, and a refund will be issued to the Customer's payment card within 14 (fourteen) days of the order cancellation.
8.4. All changes and/or corrections indicated above will apply exclusively to purchase orders sent after the date of the modification or correction made by Maggini Group S.r.l.
9. LEGAL WARRANTY FOR NON-CONFORMING PRODUCTS
9.1. The Products offered for sale are covered by a legal warranty of 24 months from the date the Customer receives them ("Legal Warranty Period"). The Legal Warranty Period covers any defects and non-conformities of the Products. Except for any other remedy under applicable law, if, during the Legal Warranty Period, it is discovered that a Product delivered to the Customer is defective or not in conformity with the ordered Product ("Defective Product"), the Customer, conditioned upon promptly reporting the defect, has the right to return the Defective Product to the Company, which can refund the price and, if available, replace the Defective Product with a new one, provided that the defect is not due to the Customer's prior misuse of the Product.
9.2. The return of Defective Products for repair must be carried out according to the following procedure:
(a) Customers must inform the Company of any defects or non-conformities of the purchased Products within the Legal Warranty Period by writing to Customer Service via email, indicating the details of the Product and a description of the defect.
(b) The return of the products must be done in accordance with the instructions provided for returns by the Amazon logistics service. The shipping costs for the return will be borne by the Company.
9.3. If the Customer chooses to use different return methods, the Company will not be responsible for any loss of the Product.

9.4. Maggini Group S.r.l. reserves the right to inspect the returned Products to verify the existence of the defect or non-conformity and may return the Products to the Customer if it believes that there is no defect or non-conformity.
10. RESPONSIBILITY OF MAGGINI GROUP S.R.L.
10.1. The Products offered for sale on the Site are provided based on availability. Except for the legal warranty mentioned in point 9 above, the Company does not provide any contractual warranty, condition, commitment, or term, whether expressed or implied, by contract or otherwise, regarding the condition, performance, satisfactory quality, or fitness for a purpose of the Products beyond the product description included in the purchase order. All such warranties, conditions, commitments, and terms of such nature are excluded to the fullest extent permitted by law.
10.2. Under no circumstances will the Company be liable for damages of any kind, including but not limited to direct, indirect, incidental, or consequential damages, possibly caused to the Customer and arising directly or indirectly:
a. from the use or inability to use the Site by the Customer;
b. from the Customer's reliance on the information contained on the Site;
c. from errors, service interruptions, deletions, damages, or corruption of email files, software errors, viruses or defects, delays in operation or transmission, lack of communication, theft, destruction, or unauthorized access to data, programs, or services of the Company.
11. APPLICABLE LAW AND JURISDICTION
11.1. These Terms of Sale are governed in all respects by Italian law. For any dispute related to the interpretation, execution, and these Terms of Sale, the competent court will be the Tribunal of the place where the Customer, as a consumer, has their residence if located in the Italian State.
11.2. If any of the provisions contained in these Terms of Sale is considered invalid, null, or unenforceable for any reason, that provision will be deemed separate and will not affect the validity and enforceability of the other provisions.
